By accessing or using Xtro (the "Service"), provided by XTRO.dev ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and XTRO.dev. We reserve the right to modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

Xtro is a cross-device IDE front-end that enables you to access and control your Mac's IDE terminals (VS Code, Cursor) from your iPhone and other devices. The Service includes:

• Cross-device terminal synchronization
• Source control and diff viewing
• Voice-to-text AI agent prompting
• Screenshot uploads and custom quick key sets

3. Privacy and Data Protection

Your privacy is important to us. By using Xtro, you acknowledge and agree to our data handling practices as outlined in our Privacy Policy:

• Terminal Data: Terminal sessions are transmitted in real-time through our relay servers but are not logged or stored
• Device Pairing: Device identifiers and names are stored to maintain authorized connections
• Local Connections: VS Code connections use direct localhost WebSocket connections and do not pass through our servers

4. Account Registration and Security

To use Xtro, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

You may not share your account credentials or allow others to use your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Payments

Subscription Plans

Xtro offers the following subscription plans:

• Monthly: $10/month, billed monthly
• Yearly: $100/year, billed annually
• Lifetime: $150 one-time payment

Billing and Renewals

Subscriptions automatically renew at the end of each billing period unless canceled. By subscribing, you authorize us to charge your payment method on a recurring basis. You can cancel your subscription at any time through your account settings or by contacting support.

Refunds

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any law
• Attempting to gain unauthorized access to any portion of the Service
• Reverse engineering, decompiling, or disassembling any part of the Service
• Creating multiple accounts to circumvent device or usage limits
• Sharing your account credentials or subscription access with others
• Interfering with or disrupting the Service or servers
• Circumventing any payment systems or subscription mechanisms
• Using the Service to transmit malware, viruses, or malicious code
• Harvesting or collecting user data without consent

7. Intellectual Property Rights

The Service and all content, features, and functionality are owned by XTRO.dev, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XTRO.DEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, for any reason including violation of these Terms or failure to pay fees.

Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
